Die Wet op Rampbestuur is vir maande aaneen in 2020 en 2021 misbruik om drakoniese polisiestaat-toestande aan die publiek op te dring, met arbitrêre maatreëls soos ’n verbod op die verkoop van alkohol en warm hoender. Inperkings deur die sentrale regering het sakeomgewings, ekonomieë en die sosiale orde geweldige skade berokken. Dit mag nie weer gebeur nie, en litigasie selfs ná die ramptoestand kan regspresedent vestig om die herhaling daarvan te voorkom. Sakeliga gaan daarom voort met 'n hofsaansoek in die Hooggeregshof in Pretoria om te verhoed dat die Wet op Rampbestuur in die toekoms misbruik word om drakoniese maatreëls deur middel van regulasie-maak af te dwing. Sakeliga wil ook spesifiek verhoed dat 'n ramptoestand keer-op-keer verleng kan word te verleng sonder dat daar objektief 'n ramp bestaan. Sakeliga vra onder andere ook dat die Nasionale Rampbestuursentrum se versuim oor verskeie maande om te bepaal of Covid-19 aan die definisie van 'n "ramp" voldoen, onwettig en ongrondwetlik verklaar word en dat ’n “nasionale ramptoestand” nie verleng mag word in afwesigheid van 'n klassifikasie deur die Nasionale Rampbestuursentrum van ’n situasie as 'n objektiewe "ramp" en "nasionale ramp" nie.
Summary
The Disaster Management Act was abused for months during 2020 and 2021 to enforce draconian police-state conditions on the public, with arbitrary measures such as banning the sales of alcohol and hot chicken. Lockdowns imposed by the central government caused enormous damage to business environments, economies and the social order. This should not happen again, and litigation even following the state of disaster can establish a legal precedent to prevent a repetition. Sakeliga therefore is proceeding with a court application in the Pretoria High Court to prevent the Disaster Management Act from being abused in the future to enforce draconian measures by proclaiming regulations. In addition, Sakeliga specifically wants to avoid the repeated extension of a state of disaster without objectively there being a disaster. Among other things, Sakeliga also requests that the National Disaster Management Centre’s failure for several months to determine whether Covid-19 meets the definition of a “disaster”, be declared unlawful and unconstitutional and that a “national state of disaster” may not be extended in the absence of a classification by the National Disaster Management Centre of a situation as an objective “disaster” and “national disaster”.
