Sakeliga het in 2020 regstappe van stapel gestuur om die regering se rekords van besluitneming oor Covid 19-inperkings te bekom sodat moontlike toekomstige vergrype onder die vaandel van 'n ramptoestand proaktief deur Sakeliga en ander voorkom kan word. Die regsverrigtinge het 'n wending geneem met die weiering deur die Minister van Samewerkende Regering en Tradisionele Sake om Sakeliga te voorsien van enige rekords, redes, verslae, bevindings, konsultasies, kommunikasie, memorandums en/of verdere dokumentasie waarop sy staatgemaak het toe sy herhaaldelik haar magte uitgeoefen het om die land in die greep van 'n grendelstaat te hou. Na 'n regstryd van twee jaar, deurspek met die regering se misbruik van hofreëls en vertragingstaktieke, het Sakeliga daarin geslaag om 'n verstekvonnis teen die Minister op 9 November 2022 te verkry. Tot vandag toe is sy steeds in minagting van die bevel, en Sakeliga volg 'n proses om haar aan minagting van die hof skuldig te laat bevind.
Summary
Sakeliga launched legal proceedings in 2020 to obtain the government's records of decision-making regarding Covid 19 lockdowns so that possible future transgressions under the banner of a state of disaster can be prevented proactively by Sakeliga and others. The legal proceedings took a turn with the refusal by the Minister of Cooperative Governance and Traditional Affairs to provide Sakeliga with any records, reasons, reports, findings, consultations, communication, memoranda and/or further documentation she had relied upon when she repeatedly exercised far-reaching powers under the Disaster Management Act to keep the country in the grip of a lockdown state. Following a legal battle of two years, replete with the government’s abuse of court rules and delaying tactics, Sakeliga succeeded in obtaining a default judgment against the Minister on 9 November 2022. Up to this day she still is in contempt of the order, and Sakeliga is following a process to have her found guilty of contempt of court.
