Die Minister van Finansies het na aanleiding van Sakeliga se Konstitusionelehof-oorwinning op 16 Februarie 2022 teen BEE in staatsverkryging, ‘n dringende hofaansoek ter wysiging van die bevel gemaak. ’n Wysiging van die bevel sou die regshulp wat Sakeliga na ’n regstryd van vyf jaar bekom het, verwater het. Sakeliga het die aansoek om wysiging van die gunstige 16 Februarie-bevel suksesvol geopponeer. In sy uitspraak het die hof nie net in Sakeliga se guns beslis nie, maar ook die Minister vermaan.
Summary
Arising from Sakeliga’s victory in the Constitutional Court on 16 February 2022 against BEE in state procurement, the Minister of Finance brought an urgent court application to amend the order. An amendment of the order would have watered down the legal aid Sakeliga had obtained following a legal struggle of five years. Sakeliga successfully opposed the application for amendment of the favourable 16 February order. In its judgment the court not only ruled in favour of Sakeliga but also admonished the Minister.
