Die EFF en Julius Malema het in 2019 geslaag met ’n aansoek na die hooggeregshof dat artikel 18(2)(b) van die Wet op Oproerige byeenkomste, wat aanhitsing om misdade insluitend betreding van eiendomme te pleeg, ongrondwetlik verklaar word. Die saak is gemaak na aanleiding van strafregtelike vervolging van Malema weens sy aanhitsing van volgelinge om grond te beset. Die hooggeregshofuitspraak is gevolglik na die Konstitusionele-hof vir bevestiging van grondwetlike ongeldigheid verwys. Sakeliga het in die Konstitusionele-hof toegetree as /amicus curiae/ (vriend van die hof) en unieke submissies gemaak ter ondersteuning van die behoud van die misdaad van aanhitsing en meegaande vonnisbepalings. Die hooggereshofuitspraak insake die ongrondwetlikheid van vonnisbepalings vir die misdaad van aanhitsing, is gevolglik deur die Konstitusionele-hof ter syde gestel.
Summary
The EFF and Julius Malema in 2019 succeeded with an application to the High Court that section 18(2)(b) of the Riotous Assemblies Act, prohibiting incitement to commit crimes, including unlawful entering upon properties, be declared unconstitutional. The case by the EFF was brought following criminal prosecution of Malema for inciting followers to occupy land. The High Court’s judgment consequently was referred to the Constitutional Court for confirmation of constitutional invalidity. Sakeliga joined in the Constitutional Court as amicus curiae and made unique submissions in support of maintaining the offence of incitement and accompanying sentencing provisions. Consequently, the High Court judgment regarding the unconstitutionality of sentencing provisions for the offence of inciting was set aside by the Constitutional Court.
