Die Mededingingskommissie het riglyne gepubliseer vir toepassing van artikel 12A van die Wet op Mededinging, ingevolge waarvan die Kommissie openlik daarop aandring dat partye tot groot transaksies BEE en ander transformasiemaatreëls moet bevorder as 'n voorwaarde vir toelating van die transaksie. Sakeliga gaan daarteen litigeer, asook oor die grondwetlikheid van artikel 12A van die Medingingswet wat vir die eerste keer vereistes in mededingingsreg inbring wat niks met markondersoeke te make het nie.
Summary
The Competition Commission has published guidelines for the application of section 12A of the Competition Act, in terms of which the Commission openly insists that parties to major transactions must promote BEE and other transformational measures as a condition for permitting the transaction to go ahead. Sakeliga is going to litigate against it, as well as the Constitutionality of section 12A of the Competition Act, which for the first time introduces requirements in competition law that have nothing to do with market investigations.
